Brussels has drawn a line. Starting today, companies must label AI-generated images, audio, video and text that look convincingly real. The requirement, part of the European Union’s landmark AI Act, aims to curb deception in an era when synthetic media can mimic reality with alarming precision.

According to The Guardian, the rules kick in for new AI systems on August 2. Those already on the market receive until December 2 to comply with the machine-readable marking obligations. Providers must embed technical watermarks or metadata that allow detection of artificial origins. Deployers — the organizations actually using these tools — face duties to add visible disclosures.

But the obligation comes with carve-outs. Content created for personal use escapes scrutiny. So does work that is clearly artistic, satirical or fictional. The law targets material designed to appear authentic or truthful. A deepfake video of a politician delivering a false speech would require labeling. A whimsical cartoon generated by AI probably would not.

The European Commission has released a set of optional icons to help. Available in black, white and semi-transparent versions, these icons pair best with plain-language text such as “AI generated” or “AI modified.” User testing across France and Romania showed that the acronym “AI” combined with explanatory words outperformed icons alone in building understanding and trust. The icons are freely downloadable and carry no attribution requirement. Still, the Commission stresses that using them does not automatically satisfy the legal standard. Clear, perceivable disclosure at first exposure remains essential.

This push reflects growing alarm over manipulated media. Examples abound. A fake video of French President Emmanuel Macron dancing spread rapidly. Audio clips falsely attributed conspiracy claims to Slovak officials. Videos purporting to show UK politicians in compromising situations circulated during elections. Each incident eroded public confidence. The Guardian quoted Sergey Lagodinsky, a member of the European Parliament, who said transparency “is something which we need to preserve our democracy and the authenticity of facts online.”

Yet industry voices express reservations. The Computer & Communications Industry Association warned that broad interpretations could flood users with labels, creating fatigue rather than clarity. Boniface de Champris, an AI policy lead, told Engadget that consumers might be surprised to see disclosures appear in advertising, film and publishing. Tech companies have already begun experimenting. TikTok has labeled more than three billion pieces of AI-generated content. Google’s SynthID tool has marked over 100 billion images and the equivalent of 60,000 years of audio. Meta and Google have signed the EU’s voluntary Code of Practice on Transparency of AI-generated Content, joining nearly 190 organizations. That code, finalized by the Commission, offers practical guidance on marking outputs and labeling deepfakes. Adherence is not mandatory, but regulators will view it favorably as evidence of compliance.

The Code splits responsibilities. Providers of generative systems must ensure outputs carry machine-readable marks that are hard to remove and work across different platforms. Deployers who publish AI-created text on matters of public interest must disclose its synthetic nature unless a human editor with real responsibility has reviewed it. For deepfakes — content that appreciably resembles real persons, objects, places or events and would mislead a reasonable observer — visible labels, on-screen text or audio warnings are required.

Fines for violations can reach €15 million or 3 percent of global annual turnover, whichever is higher. National authorities will enforce the rules, though questions linger about consistent application across 27 member states. Spain has already signaled aggressive penalties, with draft legislation that could impose up to 7 percent of turnover for serious labeling failures, per earlier Reuters reporting.

Technical hurdles remain formidable. Watermarking images and audio has advanced, yet determined actors can strip or alter these signals through editing or recompression. Text presents even greater difficulty. Minor changes to AI-written copy can erase detectable patterns. One recent X discussion highlighted how regulatory goals of robustness and interoperability clash with the fragile nature of linguistic watermarks. The European Commission’s Code of Practice page acknowledges these challenges and encourages collaboration through signatory task forces.

Platforms operating globally face a patchwork. YouTube already auto-labels some AI videos. Meta launched its own detection and labeling system this month, then pledged to help reduce a proliferation of competing standards that could confuse users. A Verge article captured the irony: the company that contributed to label fatigue now says it wants to solve the very problem it exacerbates.

Exemptions aim to protect creativity and free expression. Clearly fantastical content falls outside the deepfake definition. Law enforcement tools authorized to create synthetic material for investigations also receive carve-outs, provided the use stays within legal bounds. The guidelines emphasize that disclosures must be proportionate. Over-labeling risks turning every creative tool into a bureaucratic headache.

Newsrooms, marketing departments and customer-service operations that rely on generative AI for public-facing material now find themselves in scope. A press release drafted primarily by AI and published without meaningful human oversight on a topic like public health policy would require a label. The same release heavily edited by journalists might not. The distinction turns on editorial responsibility, a concept familiar to traditional media but newly applied to algorithmic output.

Supporters see the rules as a necessary floor. Henna Virkkunen, the EU’s technology chief, described the AI Act as establishing “a clear, risk-based and durable framework for trustworthy AI.” Critics counter that the measure arrives late and may prove ineffective against sophisticated adversaries who operate outside the EU or simply ignore the rules. Content can cross borders instantly. A label applied in compliance with Brussels standards might vanish when the same file circulates on platforms with weaker enforcement.

Still, the move signals a broader shift. Regulators no longer treat generative AI as a novelty. They view it as infrastructure that shapes information flows, political discourse and commercial trust. By mandating disclosure, the EU hopes to restore some measure of predictability in an environment where seeing no longer equals believing.

Implementation will test the balance between protection and practicality. Companies must inventory their AI uses, update contracts with vendors, train staff and integrate labeling into workflows. Smaller firms may struggle with the technical demands of robust watermarking. Larger ones already investing in provenance tools could gain advantage. The Commission’s guidelines and Code of Practice offer some shelter, yet the ultimate judgment rests with market surveillance authorities.

And the clock is running. For many organizations the August deadline feels abrupt. Preparations that began after the AI Act’s 2024 passage have accelerated in recent months. Those who signed the Code gain practical templates and peer networks. Those who did not must still meet the same legal bar through equivalent means.

The experiment now begins in earnest. Users will encounter more labels. Some will ignore them. Others may grow more skeptical of all digital media. Either way, the days of seamless, unlabeled synthetic content reaching European audiences without warning have ended. The question is whether the new regime delivers meaningful transparency or simply adds another layer of digital fine print.
