The article discussed whether criminal defendants should be entitled to a downward departure for not taking a case to trial despite filing a motion to suppress on a constitutional issue. Currently, the guidelines do not address the split in the appellate courts and the proposed amendments from the Commission did not rectify the issue. Attorney Azhari also submitted his article to the Commission at the request of one of the attorneys sitting on the Commission.

Sami Azhari has been representing criminal defendants his entire career. Having practiced in large cities like Chicago and Los Angeles, he now has a boutique law firm focusing on federal and white-collar criminal litigation across the country.
